Privacy Policy

This privacy policy complies with the French Data Protection Act, the LCEN and the GDPR. It describes how JC Billerey Photography collects, uses and retains your data, and what your rights are.

1. Preamble

The Site is published and operated by JC Billerey Photography, sole proprietor, located at 5 allée Claudie Haigneré, 94800 Villejuif, France, registered under SIRET 90460576300013 and EU VAT number FR92904605763. I work as a craftsman photographer and offer my services as such.

This Privacy Policy complies with the following legal provisions:

French Law No. 78-17 of 6 January 1978 on data processing, files and individual liberties, as amended by Law No. 2018-493 of 20 June 2018;

French Law No. 2004-575 of 21 June 2004 for trust in the digital economy (LCEN);

Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

In the course of my business, JC Billerey Photography processes and collects personal data from Users who interact with any feature on the Site.

The purpose of this Privacy Policy is to inform the User, as the data owner, about the manner and purposes of collection and processing, as well as the various rights available. This document may be amended by JC Billerey Photography to keep pace with legal developments and my practices. The User will be informed of the impact on the processing of their data.

2. Definitions

JC Billerey Photography is the term designating the data controller, also the Publisher of this Site.

  • "Client" means the professional or individual who has contracted with JC Billerey Photography by signing a contract, making a purchase, etc.
  • A "Cookie" is a small tracer file placed on the User's terminal to record information relating to their browsing of the Site.
  • "Data" means personal data, within the meaning of the GDPR, i.e. information enabling a person to be identified directly or indirectly.
  • "Privacy Policy" means this document.
  • "Data Controller" is responsible for determining the purposes and means of processing Data.
  • "GDPR" means Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  • "Site" means the website accessible at any time via https://modelglance.com.
  • "User" means any person browsing the Site and consenting to transmit their Data as defined in this Privacy Policy. A User may be a Client, but the reverse is not necessarily true.

3. Data controller

JC Billerey Photography is the Data Controller for the Data collected on the Site. I undertake to use it proportionately and to keep a simplified record of processing activities, in accordance with the GDPR.

I implement all necessary measures to secure the processing and storage of collected Data using appropriate technical and organisational measures. In the event of a proven risk of breach of the User's Data, JC Billerey Photography will naturally cooperate with the CNIL and, if necessary, inform the data owner of all steps taken to establish a solution.

4. Data collected

Data is collected lawfully and transparently in relation to the persons concerned and in accordance with the GDPR. In the course of my business, JC Billerey Photography is required to collect certain Data in order to provide personalised information and adequate responses to those who request it, to provide services, etc.

5. Purpose of processing and legal bases

The collection and processing of data are based on the following GDPR legal bases:

  • The User's consent;
  • The legal obligation of JC Billerey Photography;
  • The performance of a contract;
  • The legitimate interest of JC Billerey Photography, limited to respect for the User's personal interests.

In order to benefit from most of the Site's or JC Billerey Photography's services, the User consents to sharing their Data: booking and scheduling a discovery call; scheduling an appointment; digital and/or physical delivery of photographs; completing the contact form to receive a response to their request; completing any other form to obtain content offered by JC Billerey Photography; requesting a quote for a service offered by JC Billerey Photography; subscribing to the newsletter.

If the relationship becomes formal between the User and JC Billerey Photography, the former then becomes a Client. The Data collected then becomes useful for any purpose of preparing quotes, contracts, invoices, etc. JC Billerey Photography complies with its legal and contractual obligations.

Regarding the newsletter service, the User's consent is requested before subscribing, while having access to this Privacy Policy. Each email received as part of the newsletter contains an unsubscribe link enabling the User to stop receiving emails.

6. Data retention

The retention of collected Data is limited to the following periods:

  • 5 years after delivery of the photographs by JC Billerey Photography;
  • 3 years after the User unsubscribes from the newsletter;

Beyond the above periods, certain retention periods comply with legal deadlines, such as those for invoices (10 years) or cookies placed on the User's terminal (13 months).

7. Recipients of Data and subprocessors

The Data Controller, namely JC Billerey Photography, is the recipient of the Data. To carry out my business, I use various subprocessing services:

  • Selzy, Acumbamai and SwipeOne for the newsletter service;
  • Paypal, Pabbly Payments and Stripe for online payments;
  • Zcal for appointment scheduling;
  • Deftform for forms.

Each of these tools has its own privacy policy, over which JC Billerey Photography has no control. However, the User is invited to consult them. Some hosting arrangements for these platforms are outside the European Union and involve data transfers outside the EU. JC Billerey Photography then ensures that these platforms implement processing and protection measures similar to GDPR regulations.

JC Billerey Photography never has access to your banking details.

8. User rights

At any time, the User may exercise the following rights regarding the processing of their Data:

  • The right of access, enabling them to know what Data is held by JC Billerey Photography and to obtain a copy of the retained Data;
  • The right to rectification, enabling them to have inaccurate or incomplete Data corrected;
  • The right to erasure ("right to be forgotten"), enabling them to have Data held by JC Billerey Photography deleted;
  • The right to data portability to other service providers;
  • The right to object in the case of prospecting, particularly commercial prospecting.

The prior consent given regarding the collection and processing of the User's Data may be withdrawn at any time by sending an email request to: hello@modelglance.com. Processing carried out prior to such request remains lawful.

All other rights may also be exercised by email at the address mentioned above. The request must be written and explicit. JC Billerey Photography undertakes to process it within one month.

The User may lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertes - CNIL) if they believe their Data has been breached by JC Billerey Photography. This complaint must be justified, detailed and made as soon as they become aware of such an event.

9. Cookies

The User's browsing of the Site may result in Cookies being placed on their terminal. Cookies enable the processing of statistics and traffic information on the Site, facilitate navigation and improve the Site's service.

Several types of Cookies should be distinguished: cookies necessary for the proper functioning of the Site and enabling access to it; functional cookies that store the User's browsing personalisation choices. The User's consent is not requested for these first types of Cookies.

Analytical cookies that collect information and enable the Site's audience to be measured using statistics; advertising cookies that enable personalised advertisements to be sent; cookies identifying traffic from social networks (Instagram, Facebook, Twitter, Pinterest) that enable Site content to be shared on social networks. These Cookies are not essential to the operation of the Site and may therefore be refused or disabled by the User. A cookie banner appears as soon as the Site opens, allowing the User to choose which Cookies are active during browsing.

In any case, the User can disable the placement of Cookies directly via their browser settings. Any malfunction of the Site or a Site service resulting from this choice cannot engage the responsibility of JC Billerey Photography.

Cookies are retained on the User's terminal for a maximum period of 13 months.
