Article 1. Purpose
These Terms of Use (the "Terms") set out the rules governing access to and use of the ModelGlance website, available at modelglance.com (the "Site"), as well as the services and tools offered on it (the "Services").
By accessing the Site or using the Services, you acknowledge that you have read, understood and accepted these Terms without reservation. If you do not accept these Terms, you must not use the Site.
Article 2. Definitions
In these Terms, the following terms have the meaning set out below.
The "Publisher" refers to the party responsible for publishing the Site, whose full identity is set out in the legal notice.
The "User" refers to any person who accesses the Site, whether or not they hold an account.
The "Account" refers to the personal space created after registration, giving access to reserved features.
"User Content" refers to all items you post or upload to the Site, in particular your photos, portfolios, comp cards and measurements.
The "Directory" refers to the list of verified modeling agencies and photographers featured on the Site.
Article 3. Acceptance and amendment of the Terms
Use of the Site constitutes full acceptance of these Terms in the version in force at the time of access.
The Publisher reserves the right to amend the Terms at any time, in particular to reflect changes in the Services or in applicable law. The applicable version is the one published on the Site on the date of your use. In the event of a significant change, you will be informed by an appropriate means. Continued use of the Site after an amendment constitutes acceptance of the new Terms.
Article 4. Description of the Services
The Site mainly offers:
- A directory of modeling agencies and photographers presented as verified, freely accessible;
- A suite of free professional tools for aspiring models (comp card generator, portfolio builder, application and casting tracker, TFP contract generator, measurements tracker, agency alerts);
- A multilingual editorial blog.
The Services are provided as is. The Publisher may modify, suspend or remove all or part of the Services, in particular for technical, editorial or legal reasons.
Article 5. Founding principle and fight against scams
ModelGlance is built on a simple principle: modeling is a profession, not a dream to be sold. A legitimate agency is paid by its clients, never by the models it represents.
Accordingly, you should never pay an agency in exchange for registration, a book, classes or the promise of a contract. The Site is designed to help you identify serious actors, but it does not replace your own vigilance. If you notice an abusive practice, you can report it to the Publisher.
Article 6. Access to the Site and registration
Access to the Directory and the blog is free and does not require an account.
Access to the tools and personalized features requires creating an Account. When registering, you undertake to provide accurate, up to date and complete information, and to keep it that way. You are responsible for keeping your credentials confidential and for any activity carried out from your Account.
The Publisher may refuse, suspend or delete an Account in the event of a breach of these Terms.
Article 7. Provisions applicable to minors
Modeling also involves children and teenagers. ModelGlance takes this into account and strictly governs use by minors.
A minor does not create an Account on their own initiative. The Account of a minor model is created and managed by their legal guardian, who accepts these Terms on their behalf and takes responsibility for the use of the Site and for the User Content published.
The legal guardian acknowledges that it is their responsibility to look after the interests of the minor, to control the information and images published, and to ensure that no action breaches the legal framework applicable to the work and image of children.
Any feature involving a minor, in particular in the context of castings, is subject to enhanced vigilance. The processing of minors' personal data is detailed in the privacy policy.
Article 8. Content published by the User
You are solely responsible for the User Content you publish. You warrant that you hold all necessary rights over this content, in particular intellectual property rights and authorizations relating to the image rights of the people depicted.
You undertake not to publish any unlawful, defamatory, misleading content, content infringing the rights of third parties, or content contrary to public decency.
By publishing User Content, you grant the Publisher a non exclusive and free license to host, reproduce and display this content, solely to the extent necessary for the operation of the Services (for example to display your public portfolio if you choose to make it public). This license ends when you delete the content or your Account, subject to technical deletion times.
Article 9. Rules of conduct
When using the Site, you agree not to:
- Impersonate a third party or provide false information;
- Publish unlawful, offensive content or content infringing the rights of others;
- Use the Site for fraudulent purposes, in particular to solicit payments from aspiring models;
- Extract, scrape or reuse Directory data in an automated way without authorization;
- Disrupt the operation of the Site or attempt to circumvent its security measures.
Article 10. Reporting and moderation
If you believe that content on the Site is unlawful or contrary to these Terms, you can report it to the Publisher at hello@modelglance.com.
The Publisher may remove any manifestly unlawful content or content contrary to the Terms, and take appropriate measures regarding the Account concerned. These measures are exercised in compliance with the regulations applicable to online services.
Article 11. Intellectual property of the Site
The Site, its structure, its editorial texts, its graphic design, its databases and its technical elements are protected by intellectual property law and remain the property of the Publisher or its partners.
Any unauthorized reproduction, representation or reuse of all or part of the Site is prohibited. Directory content may not be reused without citing the source and without prior authorization.
Article 12. Personal data
The processing of your personal data is described in the privacy policy, accessible from the Site. By using the Services, you are invited to read it.
Article 13. Availability and liability
The Publisher uses reasonable means to ensure the accessibility and proper functioning of the Site, without any guarantee that it will be uninterrupted or error free. Access may be suspended for maintenance or for any technical reason.
The tools provided are offered as an aid and do not constitute professional, legal or medical advice. You remain responsible for how you use the documents generated, in particular TFP contracts.
The Directory is compiled with care, but the Publisher cannot absolutely guarantee the accuracy, completeness or permanent currency of information about the agencies and photographers listed. Listing an actor does not constitute a contractual recommendation engaging the Publisher's liability.
To the extent permitted by law, the Publisher cannot be held liable for indirect damage resulting from use of the Site.
Article 14. Free access and evolution of the Services
As at the date of publication of these Terms, access to the Directory and the tools is free for aspiring models.
The Publisher reserves the right to introduce new services, in particular for agencies and brands. Any paid offer will be subject to specific conditions brought to the attention of the persons concerned before any commitment.
Article 15. Suspension and termination
You may stop using the Services and request deletion of your Account at any time.
The Publisher may suspend or delete your access in the event of a breach of these Terms, after informing you where possible, without prejudice to its other rights.
Article 16. Governing law and disputes
These Terms are governed by French law.
In the event of a dispute, you are invited to contact the Publisher in order to seek an amicable solution. Failing an amicable resolution, and in accordance with applicable provisions, you may refer the matter to a consumer mediator where required. Failing that, the French courts will have jurisdiction under the conditions provided by law.
